Snugs & Kisses Sitter platform terms & conditions

These Terms & Conditions ("Terms") govern participation in the Snugs & Kisses Sitter Platform (the "Platform"), operated by Snugs & Kisses, LLC ("Snugs & Kisses," "Company," "we," "us," or "our").
By enrolling in a membership, submitting a care request, and/or clicking "I Agree," you ("Client," "Member," or "Family") acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Platform Scope & Services
The Platform provides access to independent childcare providers ("Care Providers") for babysitting, childcare, on-demand sitter bookings, recurring care, and backup childcare services. The Platform does not provide medical care, doula services, postpartum doula services, overnight newborn care, sleep training, behavioral therapy, or any clinical or therapeutic services.
Overnight babysitting provided through this Platform is limited to sitter-scope childcare services and does not include overnight newborn care. Overnight newborn care is a distinct service requiring specialized training and is governed by separate agreements, qualifications, and pricing. Requests for care that fall outside sitter scope may be declined, terminated, or redirected to an alternate service at Company discretion.
2. Independent Contractor Relationship
All Care Providers are independent contractors and are not employees, agents, or representatives of Snugs & Kisses. Snugs & Kisses does not supervise or control the day-to-day activities of Care Providers and is not responsible for their acts or omissions beyond reasonable screening and referral practices.
3. Household Eligibility & Use Restrictions
Membership access is limited to one (1) private household. Nanny shares, shared care arrangements, or multi-family care are strictly prohibited. Care may only be provided at the approved service address on file. Memberships may not be transferred, shared, or reassigned. Violation of this policy may result in immediate suspension or termination without refund.
4. Child Capacity & Staffing
For safety and quality of care, up to four (4) children may be supported by one (1) Care Provider. Five (5) or more children require two (2) Care Providers. Company reserves the right to decline or modify care requests that do not meet safe staffing standards.
5. Scope of Practice & Enforcement
Care Providers may only perform services within an approved sitter scope of practice. If a Client requests services that exceed sitter scope, Company may, at its discretion, terminate the booking immediately, charge the full booking amount without refund, and/or apply an alternate approved service or rate if available. Misrepresentation of care needs or repeated scope violations may result in immediate account suspension or termination without refund.
6. Availability Disclaimer
Membership provides access to the Platform only and does not guarantee Care Provider availability for any specific date or time. All care requests, including backup care requests, are fulfilled on a best-effort basis and are subject to availability, safety considerations, and Care Provider acceptance.
7. Payments, Fees & Earned Services
Membership fees grant access to the Platform and do not include prepaid care hours. Care fees are charged separately at posted or agreed-upon rates. All payments are processed through Stripe, and a valid payment method must be kept on file.
Holiday & Special Event Services
Services scheduled on designated holidays or during special events may be subject to premium pricing as determined by Snugs & Kisses, LLC and disclosed at the time of booking.
All booking fees are deemed earned once care is scheduled and/or availability is reserved, regardless of whether services are later reduced, canceled, or terminated due to Client actions, non-responsiveness, misrepresentation, or policy violations.
8. Cancellations
Cancellations must be made at least twenty-four (24) hours prior to the scheduled start time. Cancellations made within twenty-four (24) hours of the scheduled start time will be charged the full booking amount and are not eligible for rescheduling or refund.
If a Care Provider arrives at the scheduled start time and the Client is unavailable or unresponsive, reasonable attempts will be made to contact the Client. After fifteen (15) minutes, the booking will be treated as a no-show and charged in full.
9. Health, Safety & Disclosure
Clients must provide a safe and sanitary home environment and disclose relevant medical, behavioral, or developmental needs, as well as the presence of pets, firearms, medications, and hazardous materials.
Clients must disclose any contagious illness affecting household members, children, overnight guests, or frequent visitors. Failure to disclose relevant health or safety information may result in immediate termination of services upon discovery. In such cases, the full booking amount will be charged, no reschedule or refund will be provided, and repeated violations may result in account termination.
10. Recording Devices & Cameras
In-home cameras are permitted; however, all recording devices must be disclosed in advance and clearly visible. Undisclosed or hidden recording devices are strictly prohibited and may result in immediate termination of services without refund.
11. Transportation of Children
Transportation of children by Care Providers is permitted only when expressly approved and subject to Company policy and insurance requirements. Clients should not assume transportation is permitted unless confirmed in advance.
12. Geographic Availability
Platform services are currently available within designated service areas. Geographic availability does not guarantee service coverage in all locations.
13. Screening of Care Providers
Company conducts reasonable screening of Care Providers, which may include background checks and reference verification. Screening supports safety but does not eliminate all risk.
14. Limitation of Liability
To the fullest extent permitted by law, Company shall not be liable for indirect, incidental, or consequential damages. Any liability shall be limited to the amount paid for the specific service giving rise to the claim, except in cases of gross negligence or willful misconduct.
15. Assumption of Risk & Waiver of Liability
Client acknowledges that in-home childcare and supervision of children involve inherent risks, including but not limited to accidents, injuries, illness, and unforeseen events that may occur despite reasonable care. Client knowingly and voluntarily assumes all such risks associated with use of the Platform and Services.
To the fullest extent permitted by law, Client hereby waives, releases, and discharges Snugs & Kisses, its owners, officers, agents, and representatives from any and all claims, demands, causes of action, or liability arising out of or related to the Services, except to the extent caused by Snugs & Kisses' gross negligence or willful misconduct.
16. Indemnification
Clients agree to indemnify, defend, and hold harmless Snugs & Kisses from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or related to Client's violation of these Terms, misrepresentation of information, unsafe or unsanitary home environments, failure to disclose relevant information, misuse of the Platform, or actions of third parties present in the home.
17. Termination & Account Suspension
Company may suspend or terminate accounts or memberships with or without cause, including but not limited to misrepresentation, repeated policy violations, hostile or inappropriate conduct, non-responsiveness, or safety concerns. Membership fees are non-refundable upon termination.
18. Changes to Terms
Company may modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
19. Governing Law & Venue
This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-law principles. Venue for any action arising out of or relating to this Agreement shall lie exclusively in the county in which Company maintains its principal place of business.
20. Acknowledgment & Consent
By clicking "I Agree," you consent to electronic communications, including email, text messages, phone calls, platform notifications, and informational or marketing communications from Snugs & Kisses related to services, updates, and offerings, and acknowledge acceptance of these Terms.
21. Consent to Communications
By enrolling in services, signing this Agreement, and/or using the Snugs & Kisses platform, Client expressly consents to receive communications from Snugs & Kisses, LLC, including but not limited to phone calls, emails, text messages (SMS), and platform notifications, regarding scheduling, services, billing, care coordination, updates, and related operational matters. Message and data rates may apply. Client understands that such communications may be sent using automated or manual systems and that consent to receive communications is a condition of receiving services.
Confidentiality & Privacy Client acknowledges that Care Providers may have access to limited personal, household, and child-related information necessary to provide care. Snugs & Kisses requires Care Providers to maintain confidentiality consistent with industry standards. While services are not subject to HIPAA, Client agrees that the Company may collect, store, and share information as reasonably necessary to facilitate services, comply with law, and protect safety.
Emergency Protocols In the event of an emergency, Client authorizes Care Providers to take reasonable steps to protect the child(ren), including contacting emergency services and the Client. Client remains financially responsible for any emergency services rendered.
Late Pickup & Overage Charges Care that goes beyond the booked end time will be billed automatically in additional time increments and late fees at the applicable hourly rate. Client authorizes automatic charging of overage fees to the payment method on file.
Misuse of Platform & Sitter Share Prevention Care is limited to the Client's listed dependent child(ren). Adding non-dependent children, sharing sitters between households, or misrepresenting household composition constitutes misuse of the Platform and may result in immediate termination without refund.
Account Audits & Feedback Client acknowledges that Company may audit bookings, profiles, and usage for compliance. Client may be asked to provide feedback regarding services and Care Providers as part of quality assurance.
Payment Authorization & Card on File A valid credit card must be kept on file to book services. Pre-authorization holds may be placed. No bookings may be made without an active membership and valid payment method.
